These terms apply to the use of this website and to the quotations, bookings and team-building programmes provided by MGA-Teambuild. They do not limit any rights you have under South African law, including the Consumer Protection Act.

1. Acceptance of these terms

By using this website, requesting a quotation, or accepting a quotation from us, you agree to these terms. Where a signed proposal, quotation or written agreement covers the same subject, that document takes precedence for that booking.

2. Our services

MGA-Teambuild is a mobile team-building, leadership and experiential-learning provider. We design and facilitate programmes for schools, businesses, churches, NGOs, government and community groups, usually at a venue chosen by the client, and typically for groups of 20 to 200 or more participants.

3. Use of this website

You may use this website for lawful purposes only: to learn about our services and to contact us. You may not attempt to disrupt the website, gain unauthorised access to any part of it, or use it to send unlawful, abusive or misleading content. We aim to keep the site accurate and available, but we do not guarantee uninterrupted availability.

4. Enquiries and quotation requests

Submitting an enquiry or quote request does not create a booking and does not reserve a date. It starts a conversation. Please give us accurate details, because the quotation is based on what you tell us.

5. Quotations and validity

  • A quotation is valid for 30 days from the date of issue, or until 30 days before the event date, whichever comes first.
  • Where the event is less than 30 days away when the quotation is issued, the quotation is valid for 7 days.
  • Prices are based on the group size, duration, venue, travel and requirements confirmed at the time of quoting. Changes to any of these may change the price.
  • Amounts are quoted in South African Rand and VAT is shown separately where applicable.

6. Booking confirmation

Accepting a quotation places a provisional hold only. A hold is not a reserved date and lapses at the earlier of 7 days after acceptance or 30 days before the event. A booking is confirmed only once the required payment has been received and recorded by us, and we have confirmed this to you in writing. Facilitators and equipment are allocated only to confirmed bookings.

7. Deposits, payments and outstanding balances

  • Events 30 or more days away: a 50% deposit is payable to confirm the booking, with the balance due 5 days before the event, or as otherwise agreed in writing.
  • Events less than 30 days away: 100% of the quoted amount is payable immediately.
  • Payment is by electronic funds transfer to the banking details shown on the invoice.
  • Where an amount remains outstanding and we receive no payment or communication, we may treat the booking as cancelled.

8. Cancellation, postponement and rescheduling

  • Cancellation by the client after confirmation results in forfeiture of the deposit and all monies paid.
  • We will always try to accommodate a reasonable request to reschedule to an alternative date subject to availability. Agreed rescheduling must be confirmed in writing. Additional costs already committed on your behalf, such as venue or travel bookings, may still be payable.
  • If MGA-Teambuild has to cancel for reasons within our control, and no suitable alternative date can be agreed, we will refund amounts paid for the undelivered programme.

9. Client responsibilities

  • Confirm final participant numbers and any special requirements at least 10 days before the event. Late increases may not be accommodated and reductions after final numbers are confirmed do not reduce the invoiced amount.
  • Provide accurate information about the venue, the space available, access, parking, power and ablutions.
  • Where the venue is arranged by you, ensure it is safe, suitable and available for the agreed times, and that any venue rules are shared with us in advance.
  • Ensure participants arrive on time. Programmes run to a timetable and late starts may shorten the programme.
  • Provide adult supervision for learner groups as required by the school or organisation.

10. Weather and outdoor activities

Many of our activities take place outdoors. Every programme includes a wet-weather alternative where practical. If weather makes safe delivery impossible, we will discuss an indoor alternative or a rescheduled date with you. Weather alone is not treated as a cancellation by MGA-Teambuild.

11. Health, safety and participant conduct

  • Activities involve reasonable physical participation. Participation is voluntary and participants may opt out of any activity at any time.
  • The client is responsible for telling us in advance about any medical condition, injury, pregnancy, disability or accessibility requirement that may affect safe participation, so that we can adapt the programme.
  • Facilitator safety instructions must be followed. We may stop an activity or ask a participant to withdraw where safety, abusive behaviour, or the influence of alcohol or drugs makes it necessary.
  • The client should ensure appropriate first-aid arrangements are in place at the venue.

12. Equipment and property

All programme equipment remains the property of MGA-Teambuild. The client is responsible for loss or damage to our equipment caused by wilful or negligent conduct of participants, and for any damage caused to a venue by their group.

13. Intellectual property

Our programme designs, activity formats, facilitation materials, proposals, worksheets, reports, branding, photographs and the content of this website belong to MGA-Teambuild. You may use materials we supply for your own internal purposes, but you may not copy, resell, or use them to deliver competing programmes without our written permission.

14. Photography and media

We take photographs or video at events only where consent has been arranged separately with the client, and with the school or organisation where learners are involved. Any participant may ask not to be photographed. Consent to use images for marketing is always requested separately, in writing, and may be withdrawn.

15. Limitation of liability

We take reasonable care in planning and facilitating every programme. To the extent permitted by South African law, and subject to the Consumer Protection Act, our liability for any claim arising from a programme is limited to the amount you paid for that programme, and we are not liable for indirect or consequential loss such as loss of profit. Nothing in these terms excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that may not lawfully be excluded.

16. Force majeure

Neither party is responsible for failure to perform caused by events outside its reasonable control, including natural disasters, severe weather, fire, epidemic, civil unrest, national lockdowns, extended power failure beyond normal load shedding, or government action. Where such an event prevents delivery, we will agree an alternative date or a fair adjustment with you.

17. Third-party venues and suppliers

Where a venue, caterer, transport provider or other supplier is booked by you, or booked by us on your instruction, that supplier's own terms apply to their services. We are not responsible for the acts or omissions of third-party suppliers, but we will assist in resolving any problem that affects your programme.

18. Changes to programmes

We may adjust activities, the timetable or the facilitation team where it is operationally or safety necessary. Any such change will keep the agreed outcomes and value of the programme intact, and we will tell you as soon as reasonably possible.

19. Privacy

Personal information collected through this website and through our booking process is handled in accordance with our Privacy Policy and POPIA.

20. Governing law and disputes

These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction. We ask that you raise any dispute with us first so that we can try to resolve it directly.
